These terms define how MarketLink website access, brief submissions, market intelligence, and commercial support should be used. They also set the boundary between evidence-led decision support and final business judgment.
MarketLink provides decision support, market research, sourcing review, and commercial coordination within agreed scope.
Research outputs support business judgment; they are not a guarantee of price, demand, availability, or transaction success.
Acceptance of terms
By using this website, submitting a brief, requesting access, reading a report, or working with MarketLink, you agree to these Terms of Service. If a signed agreement or statement of work applies, that agreement controls where it conflicts with these general terms.
These terms are written for business use. If you are acting for a company, you confirm that you have authority to submit information and request services on that company's behalf.
MarketLink services
MarketLink provides market intelligence, demand research, brand-entry support, sourcing support, supplier review, buyer-intent review, and related commercial coordination for East African automotive trade and adjacent machinery categories.
The exact scope, timing, deliverables, fees, access level, and review process may be agreed through a brief, proposal, invoice, order confirmation, or separate written agreement.
Briefs, reports, and research outputs
Research outputs are prepared from available sources, staff review, client input, public evidence, supplier or buyer communication, and other information that MarketLink considers relevant to the agreed scope.
- Market conditions can change quickly, including pricing, availability, route cost, taxes, regulation, exchange rates, and supplier willingness.
- Reports may include confidence levels, caveats, source notes, and recommended next steps. Those caveats are part of the output and should not be removed when a report is shared internally.
- A brief submission does not guarantee that MarketLink will accept the request, contact a particular party, secure a supplier, or recommend a transaction.
- Client-facing claims should be read together with source, date, confidence, caveat, and permission status.
Accounts and access
Some reports, member areas, and brief-status tools may require an account, approved access, or a brief ID. You are responsible for keeping account credentials confidential and for activity under your access.
MarketLink may suspend or limit access if we believe an account is being misused, shared outside the approved organization, used to scrape content, or used in a way that may harm clients, suppliers, research contributors, or the service.
Acceptable use
You agree to use the website and services for legitimate business purposes and to provide information that is accurate to the best of your knowledge.
- Do not submit unlawful, deceptive, infringing, confidential third-party, or malicious content.
- Do not attempt to bypass access controls, overload the website, scrape restricted content, or reverse engineer private systems.
- Do not present MarketLink research as a guarantee, certification, audit, legal opinion, tax advice, or customs ruling unless a specific written engagement says otherwise.
- Do not use MarketLink outputs to mislead buyers, suppliers, regulators, investors, or partners.
Commercial terms and payments
Paid work may be billed as a diagnostic fee, project fee, retainer, report purchase, access subscription, success fee, transaction support fee, or another agreed commercial model.
Fees, taxes, currency, refund rules, deliverable timing, and payment milestones are governed by the relevant proposal, invoice, order confirmation, or agreement. MarketLink may pause work where payment, approval, or required client input is overdue.
Ownership and permitted use
Unless a separate agreement says otherwise, MarketLink retains ownership of its methods, templates, research structure, tools, datasets, and website content. Clients may use paid deliverables internally for the agreed business purpose.
You may not resell, publish, train a competing system on, or redistribute MarketLink reports, member content, supplier notes, or research files without written permission.
Disclaimers and limitations
MarketLink works to provide useful, evidence-led decision support, but we cannot guarantee completeness, uninterrupted access, market outcomes, supplier performance, buyer conversion, regulatory treatment, or transaction success.
To the maximum extent permitted by applicable law, MarketLink will not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from website use, delayed information, market changes, or reliance on research outputs. Any liability for paid services is limited to the amount paid for the specific service that gave rise to the claim unless a separate written agreement states otherwise.
